General conditions of sale
Orders : With the transmission of the order, the client accepts in full these conditions of sale and delivery. The orders, whether transmitted directly or through an agent, cannot be cancelled without our permission. The orders are executed at the price in force at the time of acceptance.
Delivery time : The delivery times are only to be taken as a guide. Delay in the delivery does not give the client the right to annul, to defer payment or to claim any damages.
Delivery terms : The goods travel at the purchaser’s risk, even if on a carriage-paid basis. Claims will be taken into consideration if made within 5 days of receipt of the goods. Any damage caused by the carrier must be detected at the time of acceptance of the goods and noted in the presence of the carrier, being jointly and severally responsible.
Returns : We do not accept returns, unless they use the Right of withdraw or have previously been authorised by ourselves and are on carriage-paid basis. Only materials that we acknowledge as definitive shall be replaced free of charge. The clients are expected to check the raw material upon arrival since we are not responsible for transport costs, labour changes or damage caused by third parties as a result of the assembling of goods considered defective or under dispute. We do not accept any liability for incorrect use of our products or for any damage or personal harm as result of the use of our products.
Payments : The payment terms and sales conditions, specified on our invoices cannot be modified. In case of late payment, interest shall be charged at commercial rates. We reserve the right to cancel any consignments in progress in the case where payments have not been made within the time laid down.
Right of withdrawal : As a consumer in the European Union, you have the right to notify us that you waive the purchase, without payment of a penalty and without a statement within 14 days from the day following the delivery of the goods or on the closing date of the service agreement.
Ownership of goods : The material remains our property until the payment has been completed.
Disputes : For any dispute, Belgian law is applicable, and the competent court is the Belgian Court nearest to Wevelgem. We shall not recognise any undertaking, indication of guarantee or anything else, nor shall it have any value, even if given by our agents or colleagues, unless it has been formally accepted and undersigned by us. The models that appear in our catalogues are only to be taken as guidelines. We reserve the right to make modifications to the shape and colour, if it is due to errors of printing or copying. We reserve the right to make any modifications to the price and model, if considered necessary, without any prior notice.
